Obstructive Sleep Apnea (OSA) is a significant concern for the Federal Motor Carrier Safety Administration (FMCSA) because moderate-to-severe sleep apnea causes excessive daytime sleepiness, increasing the risk of highway accidents.
If you have been diagnosed with sleep apnea, you must prove that your condition is actively treated and controlled to maintain your Commercial Driver's License.
The CPAP Compliance Standard (4 Hours / 70% Rule)
To be certified, CPAP users must demonstrate compliance with their therapy. The industry-standard FMCSA guidelines define compliance as:
- Usage: Using the CPAP machine for at least 4 hours per night.
- Frequency: Adhering to usage on at least 70% of nights.
- Timeframe: Evaluated over a consecutive 30-day, 90-day, or 1-year period (your examiner will verify the last 90 days).
What You Must Bring to Your Appointment
If you have diagnosed sleep apnea, your physical cannot be completed without your CPAP compliance printout.
- Log into your manufacturer app (such as ResMed MyAir or Philips DreamMapper) and export a 90-day compliance report.
- If you cannot download it, contact your sleep clinic or DME supplier to print it for you.
- Bring the printed report to your physical. If compliance standards are met, you can be certified for 12 months (1 year).
